A Federal Judge Dismantles Trump's Tyranny
With a Spine of Steel & 161 Pages of Ruling Federal Judge William Young Shreds Trump
At long last, a federal judge has called the Trump administration’s latest assault on the Constitution exactly what it is: cowardly, dishonorable, and soaked in the stink of tyranny.
In a searing, 161-page opinion, Massachusetts-based U.S. District Judge William Young, an appointee of President Ronald Reagan, provided a masterclass in how bad-faith, anti-constitutional arguments should be treated in the age of Trump.
Judge Young ruled that foreign students enjoy the same free speech protections under the Constitution’s First Amendment as American citizens do.
But it’s the language he used or this opinion that was truly stunning.
Young had the temerity to begin his opinion by displaying a threatening message he received via a postcard from an anonymous MAGA maniac (whose intellect and handwriting are akin to a troubled 3rd grader.).
“Trump has pardons and tanks…what do you have?” The judge answered with uncommon dignity.
Dear Mr. or Ms. Anonymous. Alone, I have nothing but my sense of duty. Together, We the People of the United States—you and me—have our magnificent Constitution.
The judge wrote that Trump cabinet secretaries, including Secretary of State Marco Rubio and Homeland Security Secretary Kristi Noem:
..deliberately and with purposeful aforethought, did so concert their actions and those of their two departments intentionally to chill the rights to freedom of speech and peacefully to assemble.
Judge Young then proceeded to fillet the Trump administration’s argument with the surgical precision and moral clarity of an old-school patriot.
The president’s palpable misunderstanding that the government simply cannot seek retribution for speech he disdains poses a great threat to Americans’ freedom of speech.
But Judge Young saved his most caustic venom for the stormtrooper cosplay antics of Immigration and Customs Enforcement,
Their agents, in a move that is sadly no longer surprising, had the audacity to show up masked when arresting student protester Rümeysa Öztürk. As if they were raiding a crack den instead of serving a petty summons.
This Court has listened carefully to the reasons given by Öztürk’s captors for masking-up and has heard the same reasons advanced by the defendant Todd Lyons, Acting Director of ICE. It rejects this testimony as disingenuous, squalid and dishonorable.
ICE goes masked for a single reason—to terrorize Americans into quiescence. Small wonder ICE often seems to need our respected military to guard them as they go about implementing our immigration laws. It should be noted that our troops do not ordinarily wear masks.
Can you imagine a masked marine? It is a matter of honor—and honor still matters.
Not content to merely slap wrists, Young summoned the full weight of American historical revulsion: “To us, masks are associated with cowardly desperados and the despised Ku Klux Klan,” he wrote.
“In all our history we have never tolerated an armed masked secret police. Carrying on in this fashion, ICE brings indelible obloquy to this administration and everyone who works in it.”
At 85-years old, Judge Young flayed hypocrisy, mocked authoritarian bravado, and defended the tattered banner of liberty against the gaslighting and goose-stepping of the Trump brigade.
Judge Young sees the big Trump lie about immigrants and foreigners for what it is. An attempt to frighten the public into docility by making a spectacle of retribution.
This comes complete with federal agents dressed like bandits, trampling on the Bill of Rights to silence any dissent.
Young’s ruling makes clear that this isn’t a mere policy dispute; it is a moral emergency.
While the president naturally seeks warm cheering and gladsome, welcoming acceptance of his views, in the real world he’ll settle for sullen silence and obedience. What he will not countenance is dissent or disagreement.
And so the judge declared what should be obvious to any literate resident of this nation.
That the First Amendment does not vanish at the border. Lawful non-citizens in the United States enjoy the same sacred protections of speech and assembly.
And no president—however orange, ornery, or demented, may rewrite our Constitution on a whim.
In an age when many organizations, institutions, and jurists bend their knee and grovel to the lunatic King Trump, here is a judge who still stands tall and promotes the constitution, for all of us.
